Support the Blockchain Regulatory Determinism Act (BRCA) to protect non-custody services

There are many regulatory talks currently being conducted around the Genius Act and the Clear Act (Market Structure Act), and it is important for Bitcoin enthusiasts to pay attention to and support the Blockchain Regulatory Determinism Act (BRCA) – HR 1747.
The bill was reintroduced to Congress on May 21, 2025 by Rep. Tom Emmer (R-MN) and Rep. Ritchie Torres (D-NY).
It also stipulates that no blockchain developer or provider of blockchain services shall be considered a currency transmitter unless the developer or provider behind the project can control user funds.
The bill is important because both Samourai Wallet and Tornado Cash developers are currently facing the expense of operating a business of unlicensed currency transmitters, despite the fact that developers of these technologies do not control user funds.
This is also important because under the Biden administration, the U.S. Department of Justice (DOJ) not only classifies privacy services as currency transmitters, but also classifies auxiliary services such as Lightning Nodes, Summary Sequencers, and other Bitcoin and other Bitcoin and blockchain technologies.
If BRCA is not enacted into law, it may put all Bitcoin and crypto wallets, as well as other non-custodial services and technologies at risk of being violated and/or complying with KYC/AML laws.
While Rep. Emmer and Rep. Torres’ reintroduction of the bill is a positive step, Congressmen need our help to make the BRCA a priority for the current Congress.

If this behavior fails, we will face significant obstacles in Bitcoin and other blockchains and around privacy.

In reality, we will give up a lot of legal confidentiality when using BitcoinIn.
So, with these points in mind, pick up the phone and/or email your elected representative and tell them you would like to see them support the BRCA.
